When the offender does not follow the family court order of protection, it is a “violation” of the order. Violating an order of protection is a crime.

What can I do when the order of protection is violated?

You can call 911. You can pursue charges in criminal court for the violation. You also have the right to file a violation petition in Family Court. 

Each time you call the police for help, they should fill out a form called a “Domestic Incident Report” and get your description of what happened. Keep a copy for your records. You do not need to have this report to file a violation, but it may be helpful.
